Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a binding legal agreement between you and Kame House Dev Studio ("Company," "we," "us," or "our") governing your access to and use of Morsel AI (the "App"), our APIs, and related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian who accepts these Terms on your behalf.

The Service is not directed to children under 13, and we do not knowingly permit such users to create accounts.

You must provide accurate registration information and keep it current. You may not use the Service if you are barred from doing so under applicable law or if we have previously suspended or terminated your account.

3. Description of the Service

Morsel AI is an AI-powered learning application that delivers personalized, bite-sized daily lessons, quizzes, progress tracking, streaks, and optional notifications based on your learning goals and preferences.

The Service may include:

  • Account registration and authentication
  • Onboarding and learning path configuration
  • AI-generated educational content
  • Quizzes and progress analytics
  • Local and optional remote push notifications
  • Free and premium subscription tiers
  • Over-the-air app updates via Expo

Educational content only. Content generated by the Service is for general educational and informational purposes. It is not professional, medical, legal, financial, or career advice. You should verify important information independently and consult qualified professionals where appropriate.

AI limitations. Lessons and quizzes are generated using artificial intelligence and may contain errors, omissions, or outdated information. We do not guarantee accuracy, completeness, or suitability for any particular purpose.

4. Account Registration and Security

4.1 Account creation

To access most features, you must create an account using a valid email address and password. We use Google Firebase Authentication for account management. You may be required to verify your email address before full access is granted.

4.2 Your responsibilities

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us promptly at hello@kamehousedevstudio.com if you suspect unauthorized access

You may not share your account with others or create multiple accounts to abuse the Service.

4.3 Account deletion

You may delete your account at any time through Account → Privacy → Delete my account in the App, as described in our Privacy Policy. Deletion is permanent and removes your learning history and login credentials associated with that account.

5. Subscriptions, Billing, and Free Features

5.1 Free and premium tiers

The Service may offer a free tier and a paid Premium subscription with additional features. Feature availability may change over time. We may use feature flags or cohort settings during beta or rollout periods.

5.2 Purchases through app stores

Premium subscriptions and in-app purchases are processed by Apple App Store (iOS) or Google Play (Android) via RevenueCat. We do not collect or store your full payment card details.

When you purchase a subscription:

  • Payment is charged to your app store account at confirmation of purchase
  • Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the price shown in the app store
  • You can manage or cancel subscriptions in your device's app store account settings (Apple: Settings → Apple ID → Subscriptions; Google: Google Play → Payments & subscriptions)
  • You may use Restore purchases in the App to re-sync entitlements on a new device

5.3 Refunds

Refund requests are handled by Apple or Google according to their policies. We do not control app store refund decisions. Contact the applicable store for billing disputes.

5.4 Price changes

We may change subscription prices or offerings. Where required, app stores will notify you and obtain consent before charging at a new price.

6. Acceptable Use and Prohibited Conduct

You agree to use the Service lawfully and in accordance with these Terms. You must not:

  • Violate any applicable law, regulation, or third-party rights
  • Use the Service for any unlawful, harmful, fraudulent, or abusive purpose
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
  • Reverse engineer, decompile, disassemble, or attempt to derive source code from the App, except where prohibited by law
  • Scrape, crawl, or use automated means to access the Service without our written permission
  • Interfere with or disrupt the Service, including by introducing malware or excessive automated requests
  • Circumvent paywalls, subscription checks, rate limits, or security measures
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service to develop competing products through systematic extraction of content
  • Submit content that is illegal, harassing, defamatory, obscene, or infringing
  • Use the Service in any manner that could damage, disable, or impair our infrastructure or providers

We may investigate violations and cooperate with law enforcement where appropriate.

7. User Content and Feedback

7.1 Your content

The Service may allow you to submit feedback about lessons (including free-text comments and optional structured tags). You retain ownership of content you submit.

7.2 License to us

By submitting feedback or other user content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, process, and analyze that content solely to operate, improve, and personalize the Service (including training and tuning our adaptation systems and AI pipelines). This license survives account deletion only to the extent necessary for aggregated, de-identified analytics or as required by law.

7.3 Moderation

We may remove or restrict content that violates these Terms or that we reasonably believe is harmful, without prior notice.

8. Intellectual Property Rights

8.1 Our ownership

The Service — including the App, software, design, branding, logos, documentation, and the structure and selection of educational materials (excluding your feedback text) — is owned by Kame House Dev Studio or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Except for the limited license below, we reserve all rights.

8.2 Limited license to you

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on devices you own or control, solely for your personal, non-commercial learning use.

You may not copy, modify, distribute, sell, lease, or create derivative works of the Service except as expressly permitted by law or these Terms.

8.3 AI-generated content

Lessons, quizzes, and related content generated for you are provided for your personal learning use within the Service. You do not acquire ownership of underlying models, templates, or our proprietary content systems. You may not republish, resell, or commercially exploit generated content outside the Service without our written permission.

8.4 Trademarks

Morsel AI and associated logos are trademarks of Kame House Dev Studio. You may not use our trademarks without prior written consent.

8.5 Copyright complaints

If you believe content in the Service infringes your copyright, contact hello@kamehousedevstudio.com with: (a) identification of the work; (b) identification of the infringing material; (c) your contact information; (d) a good-faith statement; and (e) a statement under penalty of perjury that your notice is accurate and you are authorized to act. We may remove or disable access to material alleged to be infringing and terminate repeat infringers where appropriate.

9. Third-Party Services

The Service integrates with third-party services, including but not limited to:

  • Google Firebase (authentication)
  • Supabase (data storage)
  • PostHog (analytics)
  • Sentry (error reporting)
  • RevenueCat (subscriptions)
  • Expo (push notifications and updates)
  • Apple App Store and Google Play (distribution and payments)
  • AI providers (content generation)

Your use of those services may be subject to separate terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
  • AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT
  • DEFECTS WILL BE CORRECTED
  • THE SERVICE WILL MEET YOUR REQUIREMENTS OR LEARNING OUTCOMES

Some jurisdictions do not allow exclusion of certain warranties, so some of the above may not apply to you.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) IN NO EVENT WILL Kame House Dev Studio, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (i) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS (USD $100).

(c) SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CERTAIN DAMAGES. IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Nothing in these Terms limits liability that cannot be limited under applicable law (including fraud or willful misconduct, or death/personal injury caused by negligence where such limitation is prohibited).

13. Indemnification

You agree to indemnify, defend, and hold harmless Kame House Dev Studio and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  • Content you submit through the Service

We may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

14. Termination

14.1 By you

You may stop using the Service at any time and delete your account as described in Section 4.3 and our Privacy Policy.

14.2 By us

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, pose a security or legal risk, or if we discontinue the Service. Where practicable, we will provide notice.

14.3 Effect of termination

Upon termination:

  • Your license to use the Service ends immediately
  • We may delete your account data as described in our Privacy Policy
  • Sections that by their nature should survive (including Sections 7.2, 8, 11, 12, 13, 15, and 16) will survive

15. App Store Terms

15.1 Apple App Store (iOS)

If you downloaded the App from the Apple App Store, you acknowledge and agree:

  • These Terms are between you and Kame House Dev Studio only, not Apple Inc. Apple is not responsible for the Service or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of failure of the App to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any) in accordance with Apple's policies. To the maximum extent permitted by law, Apple has no other warranty obligation.
  • Apple is not responsible for addressing claims relating to the Service, including product liability, legal compliance, or intellectual property infringement claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as a third-party beneficiary.
  • You must comply with applicable App Store terms, including the Apple Media Services Terms and Conditions and the Licensed Application End User License Agreement (Standard EULA), except where the Standard EULA is superseded by these Terms. In the event of conflict between the Standard EULA and these Terms regarding your use of the App, these Terms govern to the extent permitted.

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.

15.2 Google Play (Android)

If you downloaded the App from Google Play, you acknowledge that:

  • These Terms are between you and Kame House Dev Studio only; Google LLC is not a party to these Terms and is not responsible for the Service.
  • Your use must comply with the Google Play Terms of Service and applicable Google policies.
  • Google is only a distributor of the App; we, not Google, are responsible for the Service, support, and content.

16. Governing Law and Dispute Resolution

16.1 Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

16.2 Informal resolution

Before filing a formal dispute, you agree to contact us at hello@kamehousedevstudio.com and attempt to resolve the dispute informally for at least 30 days.

16.3 Dispute resolution

Except where prohibited by law, disputes shall be resolved exclusively in the state or federal courts located in Delaware, United States, and you consent to personal jurisdiction in those courts.

If you are a consumer in the EEA, UK, or another jurisdiction with mandatory consumer protection laws, you may have the right to bring claims in your local courts and nothing in this section limits those rights.

17. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date and provide notice in the App, by email, or by other reasonable means where required.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Service and may delete your account.

18. General Provisions

  • Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
  • No waiver. Failure to enforce any provision is not a waiver of our rights.
  • Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • Force majeure. We are not liable for delays or failures due to events beyond our reasonable control.
  • Export compliance. You may not use or export the Service except as authorized by U.S. law and the laws of your jurisdiction. You represent that you are not prohibited from receiving U.S. exports.
